Alternatively, it could attempt to maintain separate governance regimes for the same underlying technology depending on context — a bureaucratic exercise that consumed resources without meaningfully reducing risk.

A simple rule-based algorithm that automatically rejects insurance claims based on a scoring threshold would be covered, even though it does not involve machine learning. A sophisticated large language model that generates recommendations for human reviewers would also be covered, but only when those recommendations materially influence the final decision. The regulation targets the decision, not the tool.

Second, it scales proportionally to actual impact. A company using a general-purpose AI model for low-stakes applications — content generation, customer service, internal productivity — faces no additional compliance burden under the proposed framework. The same company using the same model to influence hiring decisions or credit approvals triggers the law's requirements only for those specific decision contexts. This eliminates the perverse incentive to avoid deploying AI in Colorado entirely and focuses compliance resources on the contexts where they actually matter.

Third, it is enforceable. The original law's requirement for annual system-level impact assessments created a documentation burden that was expensive to produce and difficult for regulators to meaningfully evaluate. Colorado's proposed revision represents a potential resolution to this tension — not because other states will adopt Colorado's specific law, but because the decision-level accountability framework provides a regulatory model that is compatible with the federal preference for light-touch regulation while still providing meaningful consumer protection. If Colorado demonstrates that decision-level accountability can work in practice — producing genuine transparency without imposing the kind of system-level compliance burdens that the administration and industry oppose — it establishes a template that other states and, potentially, federal legislation could adopt.

This is not a theoretical possibility. Legislative staffers in at least three other states — California, New York, and Illinois — have been monitoring the Colorado revision process, according to sources familiar with state-level AI policy discussions. The Colorado framework's technology-agnostic scope, proportional compliance burden, and focus on consumer-facing transparency align closely with the regulatory principles that have the broadest political support across the ideological spectrum.

The EU Comparison: Convergence Through Different Paths

The timing of Colorado's revision is significant in the international context as well. The European Union's AI Act, which enters its next enforcement phase on August 2, 2026, is built on the system-level classification framework that Colorado is now moving away from. Under the proposed framework, the regulatory question is different. Does the AI model "materially influence" the lending decision? If the model generates a recommendation that a human loan officer reviews and can override based on independent judgment, the answer depends on how often the human actually exercises that override capability. If loan officers accept the model's recommendation 95% of the time, the model is materially influencing the decision even though a human is nominally in the loop. If loan officers accept the recommendation 50% of the time and apply substantial independent analysis, the model's influence is less clearly material.

This contextual analysis is more nuanced than the system-level approach, but it is also more honest. It forces companies to examine the actual role that AI plays in their decision-making processes rather than relying on the fiction that inserting a human reviewer automatically converts an AI-driven process into a human-driven one.

The proposed law addresses this directly by requiring companies to maintain records of how automated decision-making technology is used in consequential decisions, including the factors that influenced adverse outcomes and the extent of human review. Consumers who receive an adverse decision — a loan denial, an insurance claim rejection, a hiring screening exclusion — would be entitled to notification that automated decision-making technology was used and to disclosure of the specific factors that contributed to the adverse outcome.

The Neural Data Question

One of the most forward-looking aspects of the broader Colorado regulatory discussion — reflected in the state's companion privacy legislation — is the explicit recognition of emerging data categories that did not exist when most privacy laws were drafted. Several state proposals, including elements being discussed in Colorado, have identified "neural data" and "biological data" as categories requiring specific protection.

This is not theoretical. Brain-computer interface companies, including Neuralink and its competitors, are generating neural data from human subjects. Wearable health devices are generating continuous streams of biological data — heart rate variability, sleep patterns, stress indicators — that AI systems can analyze to make inferences about individuals' mental and physical health states. The question of how this data should be treated under privacy law, and whether AI systems that process it should be subject to specific restrictions, is becoming urgent.

Colorado's decision-level accountability framework is well-suited to address these emerging data types. Rather than trying to anticipate every category of sensitive data and prescribe specific handling rules — an approach that inevitably lags behind technological development — the framework focuses on the decisions that are made using any data. If a neural data analysis influences a consequential decision about an individual's employment, insurance, or healthcare, the decision-level framework applies regardless of the specific data type involved.

The Compliance Industry's Response

The shift from system-level to decision-level regulation has significant implications for the rapidly growing AI compliance industry. Companies like Credo AI, Holistic AI, and various AI governance platforms have built their products around the system-level classification frameworks adopted by the EU and the original Colorado law. These platforms help companies categorize their AI systems, conduct impact assessments, and generate the documentation required for compliance.

A move to decision-level accountability would not eliminate the need for compliance tooling, but it would shift the focus from system classification to decision monitoring. Companies would need tools that track how automated decision-making technology influences specific outcomes, maintain audit trails for consequential decisions, and generate the consumer-facing disclosures required by the proposed framework. This represents a different product category — one focused on operational monitoring rather than periodic assessment — and it opens opportunities for a new generation of compliance tools built for the decision-level paradigm.

The stakes of getting this right are substantial. As of May 2026, the Colorado General Assembly is in its final session weeks. Whether the proposed revision passes in this session, is amended significantly during the legislative process, or is deferred to a future session will determine whether the original Colorado AI Act takes effect on June 30, 2026, largely unchanged, or whether the state pivots to the decision-level framework with a January 2027 effective date.

The answer matters well beyond Colorado's borders. In the absence of federal legislation, the regulatory framework that proves workable in practice will become the de facto national standard — adopted by other states, referenced by federal agencies, and used as a benchmark by the international community. Colorado, by virtue of being first and by virtue of being willing to revise its initial approach based on practical experience, is positioned to set that standard. Whether the decision-level framework represents the right approach to AI governance is a question that will only be answered by implementation. But the willingness to ask the question differently — to regulate decisions rather than systems — is itself a significant contribution to a policy debate that has been stuck in the same conceptual framework for too long.
